Terms of Service, Use and Purchase

Welcome to Homeclub! Our websites are located at joinhomeclub.com, gohomeclub.com, and account.gohomeclub.com (this “Site”) is owned by Homeclub, LLC. (“Homeclub”). Homeclub provides website features and other products and services to you when you visit, join, schedule and use Homeclub or Homeclub services, access this Site from your mobile devices, or use software provided by Homeclub in connection with any of the foregoing (collectively, “Homeclub Services”). Homeclub provides its products and services subject to these Terms of Service.

By using Homeclub Services, you agree to these conditions. Please read them carefully.

By accessing or using this Site, mobile application or other Homeclub product or service on any computer, mobile phone, tablet, console or other device (collectively, “Device”), you acknowledge and agree that you have read, understand and agree to be bound by these Terms of Service and any other applicable law, whether or not you are a registered member of Homeclub. Homeclub may change these Terms of Service at any time without notice. When we make changes, we will post them here. Your continued use of the Homeclub Services or enrollment as a Homeclub member shall be considered your acceptance of the revised Terms of Service. If you do not agree to these Terms of Service, please do not use this Site or any Homeclub Services and immediately cancel your Homeclub membership by logging into your dashboard and press the “close my account” button.

ELECTRONIC COMMUNICATIONS
When you use any Homeclub Service or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail. You agree that all agreements, notices, disclosures, advertising, promotions and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

SUBSCRIPTION PLANS
The following terms and conditions apply if you join our neighborhood Home Maintenance Club.

STANDARD SUBSCRIPTION:   Our Standard Subscription Plan is designed to give you access to our membership services and benefits. This plan allows you to schedule and pay for any handyman, lawn, maid, hvac & mosquito control service online when you need it. Service is available for only 1 single family property address or unit number per subscription. Use of our services are limited only to the list of services we provide.  This plan is only available through our gift program, and can only be purchased by an approved agent or broker.

SYSTEMS & SECURITY BREAKDOWNS SUBSCRIPTION:  Our Systems & Security Breakdowns Plan includes 4 visits of 1-hour each to help prevent and/or fix those common issues that can happen anytime around your home. Services that can be redeemed for up to 12-months from the date you join. Once you activate this plan, you will receive a voucher with a unique code that you will use when you call into the club to schedule services. Once your included visits are used, you may schedule and pay for any additional systems & security breakdown service online when you need it. Service is available for only 1 single family property address or unit number per subscription. You may “add-on” lawn, maid or mosquito control services to this plan at anytime. Use of our services are limited only to the list of system & security breakdown services we provide.

HANDYMAN BUNDLE SUBSCRIPTION:  Our Handyman Bundle Plan includes 5 hours of services that can be redeemed for up to 12-months from the date you join. Once you activate this plan, you will receive a voucher with a unique code that you will use when you call into the club to schedule services. Once your included hours are used, you may schedule and pay for any additional handyman service online when you need it. Service is available for only 1 single family property address or unit number per subscription. You may “add-on” lawn, maid or mosquito control services to this plan at anytime. Use of our services are limited only to the list of services we provide.

MAID BUNDLE SUBSCRIPTION:  Our Maid Bundle Plan includes 2 (two) 3-hour cleanings that can be redeemed for up to 12-months from the date you join. Once you activate this plan, you will receive a voucher with a unique code that you will use when you call into the club to schedule services. This service will be performed by either one or two maids; and you currently do not have the option to choose. Your home will be added to the schedule based on the availability of the maids in your area. You will be required to choose from the service times and dates available. Once your included maid services are used, you may schedule and pay for additional maid service when you need it. Service is available for only 1 single family property address or unit number per subscription. You may “add-on” handyman, lawn or mosquito control services to this plan at anytime. Use of our services are limited only to the list of services we provide.

RECURRING MAID SUBSCRIPTION:  Our Recurring Maid Plan includes 1 (one) 4-hour maid service that can be redeemed each month from the date you join. This service will be performed by either one or two maids; and you currently do not have the option to choose. Your home will be added to the schedule based on the availability of the maids in your area. You will be required to choose from the service times and dates available. You will be issued a regular service day each month. Once your included maid services are used, you may schedule and pay for additional maid service when you need it. Service is available for only 1 single family property address or unit number per subscription. You may “add-on” handyman, lawn or mosquito control services to this plan at anytime. Use of our services are limited only to the list of services we provide.

RECURRING LAWN SUBSCRIPTION:  Lawn service is performed bi-monthly. Lawn service is seasonal and is only provided from March through November. Service includes: lawn mowing, weed-eating, edging & blowing. Price includes lawns up to 10,000 square feet. For each additional 5,000 square feet of lawn, a $10 per month fee will apply. Leaf removal, trimming of any hedges or pruning of any low lying tree branches over the walk-way and driveway will each be an additional charge of $25 and up per visit. We may ask you to send pictures to show the current condition of your lawn. A one-time initial clean-up fee may be charged (see initial clean-up fee below) if your lawn is not currently in good condition. Your home will be added to the schedule based on the availability of the lawn pros in your area. You will be issued 2 regular service days each month. Services are available for only 1 single family property address or unit number per subscription. Use of our services are limited only to the list of services we provide.

ENTERPRISE SUBSCRIPTION:  Our Enterprise Membership allows you to schedule handyman, lawn, maid & hvac services at any time, and for an unlimited number of single family property addresses or unit numbers, depending on your plan. You can schedule service for multiple one, two or three-story properties, condos, multi-family units, timeshares, or rental properties within the service area of the local club. Use of our services are limited only to the list of services we provide.

ADD-ON SERVICES:  Homeclub offers our members the option to easily “Add-on” lawn, maid & mosquito control service at the most affordable prices in town. (A) Our Lawn Pros will provide these 4 basic services throughout the year: mow, weed eat, edging and blow; and in the winter months: mow, edge & blow (as needed), and leaf removal (for a nominal fee). Price includes lawns up to 10,000 square feet. For each additional 5,000 square feet of lawn, a $10 per month fee will apply. Trimming of any hedges or pruning of any low lying tree branches over the walk-way and driveway will each cost an additional $25 and up per visit. (B) Maid service can be done on a one-time, monthly or bi-monthly basis. Call your local club for a full list of services and pricing.

HVAC FINANCE OPTIONS: NOT CURRENTLY AVAILABLE 

We reserve the right to change our service offerings at any time. Homeclub does not offer remodeling or home improvement services. Our Pros are considered “handymen”, and may not possess a license in this field of service. If a license is required in your state for “handyman” services, then ALL Pros that operate there will possess one. Your fees will never change once your membership remains active. If your membership is inactive at any time, you will be subject to pay the current membership fee to reactivate. Your membership gives you access to our online portal. The online portal is required for all members and allows you to update your payment information, change your address, and book handyman, lawn, maid, hvac and mosquito control services when you need it.

SPECIAL PROMOTIONAL OFFERS (Must have valid coupon code)
1) Free Gutter Cleaning – This special promotion includes 1 free 1-hour gutter cleaning. Service for this promotional offer is provided by your Lawn Pro, and service is scheduled at the discretion and availability of the Pro. You must contact your local Club Manager during normal office hours to schedule your 1 free gutter cleaning. Must have valid promotional flyer to redeem this offer.

2) First Month Free – This special promotion includes your first month subscription for free. You must have a valid coupon code to receive this discount, or contact your local Club Manager during normal office hours and ask for this coupon code.

3) Dollar Discounts – This special promotion includes a dollar amount off your annual subscription fee. You must have a valid coupon code to receive this discount, or contact your local Club Manager during normal office hours and ask for this coupon code.

INITIAL CLEAN-UP FEE
A one-time fee between $30 – $250 may apply to all Lawn services to cover the initial clean-up. This fee will be charged separately after enrollment, and before the first service is performed. We may ask you to send pictures to show the current condition of your lawn. This fee will be waived if the pictures show that your property has recently been cut and an initial clean-up is not needed before the start of regular service.

HAULING & DUMP FEES
A Homeclub Lawn Pro may dispose of your tree and leaf debris in a wooded area on your property (if you have an area like this) with your authorization. If you choose not to have this debris remain or you do not have a place to put this debris, then your Lawn Pro will haul the debris to the closest county dumpsite. This will result in a minimum dump fee of $120 for up to 1 ton of yard debris. For debris over 1 ton, additional charges will apply. A Homeclub Handy Pro can also take your trash debris to your curb, or haul the debris to the closest county dumpsite. This will result in a minimum dump fee of $120 for up to 1 ton of yard debris. For debris over 1 ton, additional charges will apply. Homeclub will call to get your credit card details before the Pro leaves your property. The total dump fees and hauling charges will be applied to your credit card after the dump has been made.

USAGE FEE
You must pay a usage fee for each hour of service you use, or for each service you book. The usage fee will be listed on our booking page. Homeclub reserves the right to alter or change this fee at our discretion and without notice.

USAGE LIMITATIONS
The minimum usage allowed is 1 hour, and the maximum usage allowed is 8 hours of skilled labor in a single day. The Standard membership plan allows you to book service for up to 1 single family property (2 properties if you joined during a special promotion only). Our Enterprise membership plan allows you to book service for an unlimited number of single-family properties, depending on your plan. Each booking will be performed by one (1) Pro. If the Pro determines that a job cannot be completed within the time-frame booked, then the Pro will try to notify the member before starting work. The member can then pay for additional time (if the Pro is available to do more), or the Pro will do as much as can be done with the time booked. The member will then have to book additional time to complete any remaining part of the job.

USE OF SERVICE AND AVAILABILITY
Our service is designed to help with everyday maintenance and repair needs and is not intended for emergencies or emergency response. If you have an emergency or a need for immediate service and do not see availability in our booking calendar, then you may have to seek service from other companies in order to get your emergency issue resolved. Service is based around the availability of the Pros that are on duty and that are assigned to the service you are requesting. All Pros are assigned to an area or zone for dispatching purposes. You may be serviced by the same Pro every time you book service. Our service is intentionally designed this way so the member can become comfortable with the Pro working at the property, and the Pro can become familiar with the needs and maintenance history of the property.

OUR SERVICE PROS
We partner with local contractors to provide the services we offer to our members. All Pros have been vetted by a third-party company for: criminal history, sex offender registry, terrorist watch list, SSN validation, name and address history, and driving history. We also verify insurance and state licenses (when required by state law) internally. A copy of these items is kept on file. Every contractor goes through our skills competency test before we certify them as a “Pro”, and make them a part of our network. Every Pro receives a contract to provide service to our members.

NON-SOLICITATION OF OUR SERVICE PROS
Access to hire ALL service Pros is reserved exclusively thru your member dashboard. Your subscription in Homeclub allows you to use your dashboard to book and pay your usage fees for service. Your subscription will be terminated if you attempt to hire a service Pro outside of using your dashboard and paying your usage fees.

OUR VENDOR PARTNERS
We use other contractors called “Vendor Partners” that can provide services our club Pros do not offer. You can request to either have a vendor partner call you, or the phone number to contact the vendor partner directly. We do not control the schedule, services or price of the vendor partners. You can choose to pay the vendor partner directly or to make payment to the club and have your local club pay the vendor partner for services performed. If payment is made to Homeclub, then a service charge of 3% will be added to your credit card to cover any credit card processing fees. You are solely responsible for vetting any vendor partner we send you. Homeclub shall not be liable or responsible for any loss or damage arising from the work performed by any vendor partner you use.

MEMBER RESPONSIBILITY
Each member is responsible for supplying the materials used to perform all assembly, installation, maintenance, and repairs. These materials should be present at time of service. If the member is unable to provide materials, then the Pro can either accompany the member to pick up what is needed, or do a phone sale with the local home improvement center. Time used for material pickup will be deducted from total time allowed for service.

PAYMENT INFORMATION
To join Homeclub, you must submit credit card information. You represent and warrant to Homeclub that such information is true and that you are authorized to use the payment instrument. You will promptly update your Account information located in your user portal with any changes (for example, a change in your service address or email address) that may occur. You authorize Homeclub to use any updated credit card information submitted by your credit card company directly to Homeclub. If you dispute any charges, you must inform Homeclub within thirty (30) days upon receipt of your credit card statement. We reserve the right to change Homeclub prices and fees at any time. Your continued use of the Homeclub Services after the price change becomes effective constitutes your agreement to pay the changed amount.

RECURRING BILLING
Monthly subscription fee: Your credit card on file will be set up on recurring billing. You agree to have your credit card charged each month on the date of your initial subscription. Your credit card will be charged the current subscription fee for each month that you have access to book our Services. This charge will continue until canceled. Our ability to charge your credit card constitutes your agreement to accept these terms set forth above.

Annual subscription fee: Your credit card on file will be set up on recurring billing. You agree to have your credit card charged each year on the anniversary date of your initial subscription activation. Your credit card will be charged the current subscription for each year you have access to book our Services. This charge will continue until canceled. Our ability to charge your credit card constitutes your agreement to accept these terms set forth above.

REFUND POLICY
Your monthly or annual subscription fees are NON-REFUNDABLE once service is used. You may request a full refund if service is not used and your subscription has been active for 30-days or less. Usage fees for lawn, maid, hvac or handyman services are not refundable after service has been performed.

FAIL PAYMENT, ACCOUNT ON HOLD
If your monthly or annual charge attempt has failed, and we are unable to collect payment by the due date, then you will be notified via email to update your payment information on your account. If your payment information is not updated before the second charge attempt, then your account access will be placed on hold. You will have up to 72 hours from the initial charge attempt to update your account before your membership is canceled.

CANCELLATION POLICY
ALL SUBSCRIPTION PLANS:  You can cancel your Subscription plan at any time. To cancel your subscription, you simply log into your account, then click on your name at the top right of the page and click “edit account”. Once in your account, click “manage account” on the left side of the menu. Then, at the bottom of the manage account section, click “close my account”. Once you click “close my account” again – your account will be closed! You must close your account using your online login, and cannot call or send an email requesting cancellation to our support department. Once you cancel your subscription, you must wait 30-days before you can re-join the club.

ADD-ON SERVICES:  You can cancel your “Add-on” services at any time if you feel you no longer wish to continue with your lawn or maid service. You can cancel your Add-on services without completely cancelling your account. If you cancel your Add-on services, you will still have your Subscription plan available to you until you cancel your main account.  To cancel your Add-on services, you must call your local club, or send an email requesting cancellation to our support department at: support@gohomeclub.com.  Once confirmed, your Add-on services will be cancelled.

TRAVEL PERKS
As a Homeclub member, you have access to over 100,000 vacation rentals and resort properties from around the world. Our Travel Perks are available to all members, their family and friends. Your membership allows you to book an unlimited amount of 7-night stays at any of these locations (based on availability). Prices start at just $199 for each 7-night stay at a vacation property of your choice. The price you pay is for the full 7-nights stay, and is not per person or per night.

Prices start at $199 and vary based on unit size and dates of travel. Maximum occupancy will apply to each unit rented. Homeclub’s Travel Perks can be shared with your family and friends at no additional cost to you.

Once you complete the form, a local Club Manager will contact you within 48 hours with available dates and locations for your travel. Make your selection, then make payment to complete your booking. A reservation confirmation will be sent via email within 72 hours.

No timeshare sales presentation or resort preview required. These are actual vacation stays you are booking. Use your travel benefits as often as you want. All bookings are non-refundable and cannot be cancelled once confirmed.

REAL ESTATE PERKS
When you use our in-house Real Estate Agents/Brokers to buy or sell your home, you will instantly save .5% (half of one percent) off your real estate commissions if our agent/broker is representing only one side of the transaction, and instantly save 1% (one percent) if our agent/broker is representing both sides of the transaction. Offer applies to all Homeclub members, their families, friends, Homeclub contractors and employees. Your total real estate commissions will be reduced by the discounted amount at closing, and will reflect on your HUD 1 closing statement. WINNER-A-WEEK GIVEAWAY
Book a minimum of 2 hours of service any week of the year and automatically be entered into our “Winner-A-Week” repair giveaway. Winner receives one (1) FREE hour of service. One (1) winner will be chosen each week by random selection. Winner will be notified via email, and can use the free hour of service anytime within 90 days. You must call your local club during normal office hours to redeem your free hour of service. No restrictions to the amount of times you can win.

ACCOUNT CONFIDENTIALITY AND ACCESS
You are solely responsible for maintaining the confidentiality of your member portal, all activities occurring under your member portal and all access to and use of the Homeclub Services by anyone using your member portal, whether or not such activities and access are actually authorized by you, including but not limited to all communications, transactions, and obligations. You agree to accept responsibility for all activities that occur under your member number (or username) and password. Homeclub shall not be liable or responsible for any loss or damage arising from any unauthorized use, access or any other breach of security of your member portal, including but not limited to your member sign-in password and email address. You acknowledge and accept that your use of the Homeclub Services is in compliance with these Terms of Service. You further acknowledge and accept that Homeclub shall have no obligation to investigate the authorization or source of any member portal activity, including scheduling activity following a proper log-in to this Site or any Homeclub site, which is defined as a matching and current member sign-in and user password. You shall notify Homeclub immediately of any unauthorized access to your member portal or any other unauthorized use of any Homeclub Services.

You agree that Homeclub may, without prior notice, immediately terminate, suspend or limit access to your member portal based on any of the following: (a) breach or violation of these Terms of Service; (b) upon request by law enforcement; (c) unforeseeable technical or security issues or problems; (d) extended periods of inactivity; or (e) fraudulent, deceptive or illegal activity, or any other activity which Homeclub believes is harmful to its business interests: or (f) for no reason. You agree that any termination, limitation of access and/or suspension shall be made at the sole discretion of Homeclub, and that Homeclub shall not be liable to you or any third party for the termination, limitation of access and/or suspension of your member Account.
